Definition

Fair chance hiring, often called ban the box, refers to laws and policies that remove criminal history questions from initial job applications and delay background checks until later in the process, often after a conditional offer. Many states, counties and cities have such rules for private employers, and the details differ: timing, what records can be considered and what notice is owed. Federal EEOC guidance also encourages an individualized look at whether a record actually relates to the job.
