Agreeing to these terms
These Terms of Use (“Terms”) apply to crewstaffingpros.com, our related websites and domains, our mobile apps and the tools and forms on them (together, the “Site”), operated by Crew Staffing Pros (“we,” “us” or “our”). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
Our services and other agreements
The Site describes our staffing services and lets businesses request workers and job seekers apply for work. Using the Site does not by itself create a staffing contract or an employment relationship.
- Clients: staffing services are provided under a separate service agreement and order confirmation. If those documents conflict with these Terms, the service agreement controls.
- Applicants and workers: submitting an application does not guarantee employment or any number of shifts. Employment with us is governed by your hiring documents, our policies and applicable law. Unless a written agreement says otherwise, employment is at will.
- Text messages are governed by our SMS Terms.
Estimates, rates and pay information
Rates, estimates and quotes shown on the Site, including in our quote tools, are indicative estimates for planning purposes. They are not an offer. Your actual rate depends on location, role, shift timing, certifications and other details, and is confirmed by a dispatcher before your order is final.
Pay ranges shown for roles are typical U.S. ranges and are estimates. Local pay varies. The pay for a specific shift is shown on that shift before you accept it. Our guarantee applies on the terms published on our guarantee page and in your service agreement.
Eligibility and accounts
You must be at least 18 years old to use the Site to request services or create an account. If you create an account, you agree to give accurate information, keep it current, keep your login secure and tell us promptly about any unauthorized use. You are responsible for activity under your account. We may suspend or close accounts that violate these Terms or our policies.
Acceptable use
You agree not to:
- Give false information, impersonate anyone or apply on behalf of someone else without authorization.
- Use the Site for any unlawful, discriminatory or fraudulent purpose, including posting job requests that discriminate on the basis of a protected characteristic.
- Use our name or brands to recruit, collect fees from or deceive job seekers.
- Scrape, copy or harvest data from the Site using automated tools, except as allowed by our robots.txt file for search engines.
- Interfere with the Site's security or operation, introduce malware or attempt to access systems or data you are not authorized to access.
- Hire workers introduced by us outside the terms of your service agreement.
Our content and your submissions
The Site and its content, including text, graphics, logos, the crew badge, software and the Crew Staffing Pros name and brands, are owned by us or our licensors and protected by intellectual property laws. You may view and print pages for your own personal or internal business use. You may not copy, modify, distribute or create derivative works without our written permission.
When you send us information through the Site, such as forms, ratings or feedback, you give us permission to use it to provide and improve our services, consistent with our Privacy Policy. Please do not send us confidential information you do not want us to use.
Third-party links and services
The Site may link to or integrate with third-party websites and services, such as maps, app stores, payment or pay card providers and social networks. We do not control them and are not responsible for their content or practices. Your use of them is governed by their terms.
Disclaimers
We work hard to keep the Site accurate and available, but it is provided “as is” and “as available.” To the extent allowed by law, we disclaim all warranties about the Site, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Guides and articles in our resource center are general information, not legal, tax or financial advice.
Limitation of liability
To the extent allowed by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising out of your use of the Site. Our total liability for any claim arising out of the Site will not exceed one hundred U.S. dollars. This section does not limit liability that cannot be limited by law and does not change the terms of any separate service agreement or your rights as an employee.
Indemnity
If you use the Site in violation of these Terms or the law, you agree to defend and indemnify us against claims, losses and costs, including reasonable attorneys' fees, that result, to the extent allowed by law.
Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where the law of your state must apply. Unless a separate agreement between you and us provides otherwise, disputes about these Terms or the Site will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.
Changes and general terms
We may update these Terms by posting a new version with a new “Last updated” date. Continued use of the Site after changes take effect means you accept them. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent.
